银行保函类型
对外保函主要有如下具体保函种类：
1、投标保函
主要用于国际投标与招标业务，通常是招标人要求投标人参加投标的条件之一。银行(担保人)应投标人(申请人)的申请，开立的以招标人为受益人的保函，保证投标人在开标之前不中途撤销投标、不片面修改投标条件或中标后不拒绝签约、不拒绝交纳履行保证金或提供银行的履约保函，否则银行将支付给招标人一定的金额作为赔偿。其目的在于表明投标人的诚意与资格。
2、履约保函
是银行(担保人)应交易合同中的一方当事人(申请人)的请求，开立的以另一方当事人为受益人的保函，承诺在申请人未能履行合同规定的义务时，银行将支付给受益人一定金额作为赔偿。
3、预付款保函
是指银行(担保人)应交易合同中的一方当事人(申请人)的请求，开立的以另一方当事人为受益人的保函，在申请人没有履行合同中规定的义务时，银行将保证偿还受益人预付或已付给申请人的金额。
4、质量与维修保函
是指应供货方或承建人申请，向买方或业主保证，如货物或工程的质量不符合合同约定而卖方或承建人又不能依约更换或修理时，按买方或业主的索赔予以赔偿。
5、留置金保函
是指部分进口贸易中，按合同规定对进口方尚未偿付的一小部分货款(即留置金)，应出口方的要求，由进口方向银行申请开立的留置金偿付保证书。
6、借款保函
我行接受借款方的请求，向贷款方出具保函，如借款方不按期向贷款方偿还借款本息，我行将根据贷款方的索赔，按照保函约定承担付款责任。
7、融资租赁保函
在融资租赁活动中，我行接受承租方请求，向出租方出具保函，如承租方不按期支付租金，我行将根据出租方的索赔，按照保函约定承担付款责任。
8、补偿贸易保函
银行根据设备或技术引进方请求，以出具补偿贸易保函的`形式向设备或技术提供方提供第三方保证。补偿贸易保函的服务对象是补偿贸易项下的设备或技术使用企业，为其向设备或技术提供方承诺，当设备或技术引进方在设备或技术引进后的一定时期内没有将以其所生产的成品或其他产品来抵偿所引进的设备或技术的价值，或没有以成品的外销所得的款项支付所引进的设备或技术，而且届时无法或无力做出支付或抵偿行为时，银行将根据设备或技术提供方要求，按照约定承担保证责任。

在一般货物进出口交易中，履约保函又可分为进口履约保函和出口履约保函。
⒈进口履约保函。
进口履约保函是指担保人应申请人(进口人)的申请开给受益人(出口人)的保证承诺。保函规定，如出口人按期交货后，进口人未按合同规定付款，则由担保人负责偿还。这种履约保函对出口人来说，是一种简便、及时和确定的保障。
⒉出口履约保函
出口履约保函是指担保人应申请人(出口人)的申请开给受益人(进口人)的保证承诺。保函规定，如出口人未能按合同规定交货，担保人负责赔偿进口人的损失。这种履约保函对进口人有一定的保障。
还款保函
还款保函又称预付款保函或定金保函。是指担保人应合同一方当事人的申请，向合同另一方当事人开立的保函。保函规定，如申请人不履行他与受益人订立合同的义务，不将受益人预付或支付的款项退还或还款给受益人，担保人向受益人退还或支付款项。

c) The covenants contained herein constitute irrevocable direct obligations of the Bank. No alteration in the terms of the contract to be performed there under and no allowance of time by you or any other act or omission by you which for this provision might exonerate or discharge the Bank shall in any way release the Bank from any liability hereunder.

5.贷款人在本保函项下疏于或怠于行使任何权利或补救措施等，均不应视为对该等权利的放弃;任何单项或部分行使上述权利也不能排除贷款人进一步采取行动或行使其他权利或补救措施的权利。如果在任何时候本保函的任何条款已是或变为非法、无效或在任何方面不可执行，本保函其他条款的合法性、有效性及可执行性均不应受到影响或相应降低。
5.No failure or delay by the Lender in exercising any right。power or remedy under this Guarantee shall operate as waiver thereof，nor shall any single or partial exercise of the same preclude any further exercise thereof or the exercise of any other right，power or remedy.If at any time any provision in this guarantee (hereof—20)is or becomes illegal，invalid or unenforceable in any respect， neither the legality，validity or enforceability of the remaining provisions herein shall in any way be affected or impaired thereby.
